In most states, the “legal limit” was .10. It is now .08, although in Utah, it is .05. Some states have lower limits for commercial drivers.

The legal limit is statutory amount that, if the jury or judge finds that the defendant has a BAC at or above this amount, he is intoxication. However, individuals can be convicted with a DWI with even lower BAC, or in the case of drugs, no BAC. BAC is Blood/Breath Alcohol Concentration.

In Texas, we had an individual with a BAC of .40. Anyone with a BAC of over in the .2 range or higher is an extremely hard drinker and has built up a tolerance to alcohol.

The kid who just had one too many is actually usually lower than .08, the legislature had to pick a number and with the alcohol lobbyist on one side and MADD on the other, this was generally the compromise.

.08 is common now
1.0 would be dead
