Three points to clear things up for you.
First, since the sixteenth amendment was approved, the income tax is Constitutional.
Second, the amendment passed Congress in a vote of 318–14 clearly a bi-partisan vote.
Third, it was ratified by 36 states, clearly bi-partisan support.
