No it is not, if people CHOOSE to cross sovereign state lines that is on them. As for the commerce clause are you a conservative really going to use the much abused commerce cause because remember that when the same fed tramples all over your state rights and law making ability say for gun rights. This is a clear tenth amendment case and NYS should win it unless the Supremes use the damn commerce clause again to bash states rights. No conservative EVER should support using that damn clause for anything othere than actual goods moved across lines and it was to keep the states from tariffs on each other not to empower the fed to override every aspect of the economy and laws just because a person or good crosses state lines.
