Alito and Thomas wrote in favor of granting the petition to HEAR the case before the court. They were apparently overruled in the desire to HEAR the case.
My bad....i wonder what Gorsuch’s reasoning was.
They shouldn’t have a choice but to hear cases. They the last hope for cases. If you spend millions of dollars pushing a case to SCOTUS and they refuse to hear it those bringing case should then be reimbursed for their losses. Time to put a stop to this “we chickened out” crap.
