A 19-year-old is being charged with DUI manslaughter after allegedly running over a 2-year-old and dragging him and his tricycle in a gated Florida community Monday as his horrified family watched, authorities said.
According to harrowing details from the affidavit obtained by ClickOrlando, Joshua Montero “appeared to drag the child and the bicycle” a few feet before the truck came to a halt.
The tot’s mother said she and her husband were standing in their driveway as their children were riding their bikes in the street in front of their house on the Labor Day holiday when she heard and saw the speeding truck, ClickOrlando said of the affidavit.
She and her husband began to yell at the driver to slow down when the truck continued toward the cul-de-sac, according to the affidavit.

sad.
but why let your kid (2 yrs old, tiny bicycle) ride in street if you have some drive way space? no side walks?
I resign.
The parents must be from Mars. Someone should explain to them what a street is used for. It certainly is not for kiddie tricycles.
“... saw the speeding truck,”
Slow down everybody!
My good friend and neighbor was killed monday afternoon while riding his motorcycle.
He was broad sided at an intersection. The car was going three times the speed limit.
Witnesses say he flew over 100 feet after the impact.
Slow down.
I am so sorry
They should have beaten him to death
Cul-du-sac in a gated community. I would think plenty safe for kids to play. I hope they also charge the POS that let the drunk vermin in.
from the human race?
A gated community, parents right there. Life is hardly worth living if you can’t allow kids that freedom. The flip side, is structured events only for kids.
The correct side, is harsh harsh punishment for law breakers. Why not 1st degree murder for this kind of thing?
So am I. Prayers sent for your friend 😞🙏🏻
Well, here ya go. It's a city street, and not a playground. I've literally crawled through residential neighborhoods and had kids on bikes come flying out of their driveways and run into the side of my car. All the while, the parents were nowhere in sight. I once knew a man who ran over and killed his own child while pulling out of his driveway on to the street.
Maybe it’s just me, but I never let my little ones play near a street or road. Still, drunk boy needs to pay big for this.
Cul-du-sac in a gated community? What do you Concrete bearer?
The gated communities I’ve seen have sidewalks. Why didn’t the parents get their child off the street until the vehicle passed?k I don’t understand why pedestrians think their right-of-way doesn’t include taking responsible action when necessary. If your toddler is in the street, you should be in the street with them.
You don't let children ride tricycles in the street. Drunk driver or not, parents are idiots to allow children to ride tricycles in the street.
I’d consider whether or not I deserve to live after that.
Bikes are legally allowed in streets. Tricycles are not, but it was a culdesac and the parents were right there.
It sounds like the guy was recklessly speeding while drunk driving, and the parents couldn’t get their child out of the way in time.
Tragic yet preventable.
I agree slow down. You shouldn’t be driving more than 25mph on residential streets.
From the article: “Montero’s breath sample came back at .062 and .057, which is considered over the limit since he is underage...”
I think the headline is a bit misleading as these numbers do not really indicate drunkeness in common, non-legal system terms. Nor are they in the range that accounts for the vast majority of fatal alcohol-related accidents. Florida’s law is what it is and I am thinking it is a good law and that this driver will feel the consequences of it. I am just noting that if the driver was an adult (actually 19 is an adult, but an older adult), the drinking angle would not be mentioned or charged. For these reasons, I am guessing the accident was much more directly caused by speeding.
