Because they believe in legal nihilism. Precedent, tradition and integrity have no role in their legal/ justice system. They believe it is a construct that was used to maintain the evil capitalist paternalistic structure.
Therefore, they can use it how they want to pursue their communist ends.
This is taught by leftist professors in law school.
Just like “journalists” are taught to use the “news” to overturn society and elect democrats.
