One of the complications they're factoring is that since JoePedo was declared mentally incompetent to stand trial for the classified document retention, any pardon he might issue would have basis to be challenged ... thus part of the negotiations include how the pardons are arranged + executed by any successor in the picture. Quite the tangle!
