As I recall ... in the weeks leading up to the trial in NYC, once the SCOTUS took up the Chutkan case, Trump submitted a motion to Merchan to consider presidential immunity. As I recall, Merchan would no longer allow Trump to actually submit motions for the record, they had to submit a letter to Merchan which he denied. But it really doesn’t matter ... the SCOTUS ruled yesterday that BEFORE a trial is to take place the Court must hold hearings on immunity - that did not happen. The Hill and others are noting that Trump is saying evidence was submitted that was covered to include the Tweets that IMO are absolutely within the purview of the immunity because SCOTUS said that speech by POTUS is protected. But Merchan NEVER considered anything about immunity and, thus, IMO there has to be a mistrial declared, then Merchan can hold the hearing that he never had.
