I must say - have to be careful about CJ Roberts here - notice it says he referred it to the Court. My guess is it then came back 5-4, Roberts+Thomas+Alito+Gorsuch for granting and the rest (ACB,JudgeK,Jackson,Sotomayor+Kagan against).
