Trump’s lawyers need to bring it before the SCOTUS for them to act.
Of course the NY State higher courts could act as well. And unfortunately the SCOTUS may say they have to go through state courts first.
I believe they would have to file a writ to Sotamayor sine she leads the court district. I don’t think she’s going to grant it now.
