In looking at "the color of law" further ...a different section of the U.S. code might apply to Pres. Trump and he might have to jump through hoops going after a judge...maybe a judge who imposes a gag order?
42 U.S. Code § 1983 - Civil action for deprivation of rights

For the purposes of this section, any Act of Congress applicable exclusively to the District of Columbia shall be considered to be a statute of the District of Columbia."
