I know what he said about the Constitution, but that does not mean he was calling for its replacement, remember. There are always corollaries: if the US Constitution is not adequate for the government of those other than the moral and religious (it was not supposed to be; that was the power the state governments kept for themselves), then it is still more than adequate to the punishment of the immoral and irreligious thanks to its limited powers and the scope of the powers of the states.
