"The Court's concern is less that the State has failed to allege sufficient conduct of the Defendants - in fact it has alleged an abundance. However the lack of detail concerning an essential legal element is, in the undersigned's opinion, fatal. As written, these six counts contain all the essential elements of the crimes but fail to allege sufficient detail regarding the nature of their commission, i.e. the underlying felony solicited. Kimbrough, 300 GA at 884. They do not give the Defendants enough information to prepare their defenses intelligently, as the Defendants could have violated the Constitution and thus the statute in dozens, if not hundreds, of distinct ways. id. at 882. Under the standards articulated by our appellate courts, the special demurrer must be granted and Counts 2,5,6, 23, and 38 be squashed."
So I see. I think the whole case should be dismissed.🤷♂️ The whole Trump Derangement Syndrome crowd is dragging our country into 'TILT'. If all these cases fail - except NYC and D.C. (which no longer honor the Constitution) - I worry what these deranged folk will resort to next. Time after time we see these people break all the laws and rules, and nothing happens to them👈😠

You’ll see stories about “6 out of 40,” “some charges dismissed,” etc. So here’s the real rundown.
There are three sections of charges against him — racketeering, soliciting oathbreakers, and fake electors. Soliciting oathbreakers just got thrown out entirely. This was frankly the most dangerous part. The fake electors thing is going to be thrown out of the SCOTUS, if not earlier. It’s exactly what happened with Nixon/Kennedy, and the “fake” electors then turned out to be the real electors. There’s no way for it to be the right legal move when you win the court case but a crime if you don’t. That’s now how our court system works. You are allowed to be wrong as long as you do it in court.
Racketeering stems out of combination of the other two. Forgery/whatever is just a crime. It already has its own punishment. You don’t get to call it organized crime without showing the organized part, and doing something once doesn’t rise to that.
The oathbreaking was also the most dangerous part because it was the most sexy to a jury. There’s taped phone calls, there’s famous people, there’s “did he / didn’t he,” all that. The rest? It’s boring ass old nobody white Republicans signing papers. There’s no drama there, and while you can probably get a moron jury to agree to convict on it assuming Trump’s team does nothing, the jury isn’t going to be excited about it, and it won’t take much to push them off that fence to “just move on.”
Essentially, the case against Trump in GA just took its mortal wound, and now we are just waiting for it to bleed out, assuming the judge doesn’t dismiss Faaaaaaani and put it out of its misery.
