Fair enough but two points:
(1) Biden could do this by executive order. Not legal, but that doesn’t matter to his handlers. So could blue state governors, many of whom have complicit legislatures.
(2) “Soldiers” has a very specific meaning, namely part of a military. Think it would be hard to convince a federal judge — especially a leftist one — that the illegal immigrants qualify except for those who are actually part of a military (e.g., Chinese?). Maybe not even them. One interpretation of soldiers under the 3rd is part of the U.S. military. Also, would take years to litigate. If Biden or some other Dem stooge (or Haley - same thing) gets in, we can expect more leftscum on the Supreme Court and we’d lose the argument.
Yes, that had occurred to me.
However knowing the history behind the 3 rd Amendment it would be a simple thing to argue that the 3 rd was written to prohibit the Federal government from forcing citizens to house any person in their home against their will.
In my opinion it is hard to read it any other way.
But of course your point that Leftist judges find it difficult to rule against anything that a Leftist President might want to do is well taken and not to be disregarded or considered impossible.
