The repubs would have to change their rules for this to happen.

https://www.gop.gov/conference-rules-of-the-118th-congress/

Rule 26—Temporary Step Aside of a Member of Leadership who is Indicted

(a) A member of the Republican Leadership shall step aside if indicted for a felony for which a sentence of two or more years imprisonment may be imposed.

(b) If a member of the Republican Elected Leadership is indicted, the Republican Conference shall meet and elect a Member to temporarily serve in that position.

(c) If a member of the Republican Leadership resigns pursuant to this rule, and subsequently during that Congress is acquitted or the charges are dismissed or reduced to less than a felony as described in paragraph (a), such Member shall resume the position from which they resigned, unless the Republican Conference decides otherwise within 10 legislative days.

That’s if he gets indicted -after- he’s a part of the “Republican leadership”.

Repubs change rules? When did that ever happen? Remember when Florida did that to allow DeSantis to run for prez while still guvner? If it looks like Trump is a serious candidate for Speaker I betcha a whole bunch of phony indictments would disappear. D/A’s, A/G’s all over the place could see their money disappearing on roller skates. That’s gonna happen anyway if we can re-elect Trump as Prez. I gotta see if I can find a “fear factor” meter for the swamp rats who see Trump coming again. Maybe the guy who sold me the “BS meter” has one? I’ll put on the shelf with my “give a bleep meter.”

——aaannnddd there’s a big fat loophole in the 26a rule. It only addresses “elected leadership.” Trump would be an exception to that rule simply because he’s not an elected rep. As an “outsider” he’s still qualified to be a speaker but not governed by elected leadership rules.
