I am not a lawyer.
However, my experience is that in order to enforce a Non-Compete Agreement, the former employer has to pay the former employee. Especially in California and Massachusetts.

i'm sure Don Lemon and Tucker are having their lawyer, both have the same one, figure out what they can do and what they can't do.

Generally, that’s my read as well. I can’t recall the cases and too busy to look, but my recollection is of one or two high-profile cases which set the precedent:

A non-compete is essentially invalid once employment ends, regardless of the reason for ending.

Again, NDA is a different animal.
