Gets tricky. If the government ordered it, the fraud is on the government. But colluding with fraud even under orders may not be protected. Since Nuremberg (and actually well before but that’s a reference most people know about), “I was acting under orders” is not a valid defense.

Nuremburg has never been incorporated into US law, either by statute or treaty. Any attempt to incorporate now would run into Ex Post Facto.
You can be 100% certain that the supposed “precedents” created by the Nuremberg show trial will NEVER be enforced, or even accepted as binding, upon any government which had a hand in creating the International Military Tribunal.
