I don’t have time or wits to go re-read what I posted right now, but my understanding was that if Pence had accepted the alternate electors even though the states did not contest it, that would have set a precedent that Dems could use.

not what you posted - from who, I forget...we try and vet things...

as an aside....
The alternate lists never made it to Pence. Went to archives and they didn’t forward it.
The Constitution and the Electoral Count Law both require Pence to open and accept alternate or purported certified electoral votes.
