Notice the word “viability” rather than “legality” is used. He certainly does not have the Constitutional authority to do so and viability means he has to see whether the Republicans will allow him to slip it through.

The Republicans won’t even unite to fight an unqualified female Supreme Court nominee who can’t define the word “woman”, yet is heralded by Democrats and the media as the first black woman justice. Where are the Republican voices screaming about 3 million illegals crossing the border each year, the Mexican cartels freely engaging in human trafficking and narcotics trafficking across the southern border. Where are the GOP complaints about denial of due process for the January 6 protestors? The depletion of the US petroleum reserve by shipping oil and refined products to Europe, China, and South American results in barely a whimper as does the depletion of the US arsenal due to supplies being sent to Ukraine. Is there any pressure from the GOP to cut off federal aid to schools and colleges engaged in racist CRT indoctrination? Any concern about armed forces being unable to fill recruiting quotas even after dropping the high school diploma requirement and opening the armed services to homosexuals and transgenders as well as allowing women to serve in combat?
If Biden issued an executive order overturning the recent Supreme Court decision, would we finally see some fight from the GOP?
