Speculating in this case that while the conduct observed is stipulated, uncontested ... whether or not that conduct is criminal is an allegation.

I saw this story this morning and thought to remark that for pretty much ALL “wrongs” that are criminal (except when the government harms a person), there is also a remedy in civil court. A couple example ...

OJ Simpson case.

If somebody punches you in the nose and the DA declines to prosecute, you still have a right to sue for money damages.
