I don’t think the emergency would require a nuke strike. To my simple mind, the EOs and PEADs which have been widely discussed, including in the Devolution articles, could be implemented with other emergencies. A stolen election that has had foreign interference and US citizens acting as their agents could easily be sufficient. That one right there is what my instincts are telling me as well. It's technically "outside the Constitution" simply because it's never happened before.
Also, I'd love to be added to your ping list for posts like this, if you have one. This stuff is so fascinating to me.
