As for Karen Fann and Seth Keshel’s hopeful assessment for “clearing away” for AZ Legislature to decertifying the Stolen Election of 2020, I dont get it.

Karen Fann, as Republican AZ Senate President (last I heard) was clear when she contended that yes, yes, yes, the Election was stolen, but there is no constitutional or state legislative remedy, but for necessarry repair to the system before future elections.

September 3 is the Kill Switch date, across the nation, for the speedy destruction of all 2020 ballots (and related materials?).

She is correct. I spent a delightful half hour in her office a few years ago discussing rail issues. She has a painting of Reagan at his ranch in her office, and I got a chance to tell her my favorite Reagan story.

All of the constitutional and legal procedures of the 2020 presidential election were followed to the letter, and all dates mandated by law were met. The argument that "fraud vitiates everything" doesn't apply here. Not one state legislature appointed an alternate set of Electors to Congress for the January 6 tabulation date.

If Arizona were to withdraw its Electors, it would be something to be noted in the history books, but it would have no legal effect -- but for one exception.

In 1961, President Kennedy asked the National Security Council to war-game a scenario in which the Soviets successfully executed a nuclear decapitation of the federal government. There were executive orders from the Eisenhower Administration that would handle military control after a major nuclear exchange where the country had been laid waste, but Kennedy was more interested in how the federal government could be reconstituted after a surgical strike.

The NSC lawyers reported back that:

Kennedy issued an executive order based on that finding.

The assumption was that the president, vice president and the entire chain of succession had been vaporized. The procedure to choose a new ticket would be for the national committees of the two parties to have their state party chairs meet in a safe place to pick the ticket. The Electoral College members would then meet in their state capitals to vote for the appropriate ticket, and the usual constitutional and legal procedures would apply.

This is where the withdrawal of Electors would have an effect. It could change the outcome of the electoral vote.

What if enough states had withdrawn their Electors to prevent either ticket from getting the necessary 270 electoral votes?

Then the Electoral College would fail to elect a ticket, and the House and Senate would choose according to the procedures set forth in the 12th Amendment.

Reconstitution of government is the one area where withdrawal of Electors could have an effect.
