I am researching what to do if you are fired due to the vaccine mandate. Went to the Liberty Council website and found this regarding the process……

Maybe I’m reading this wrong so if there are any lawyers out there that can help me out with the rationale behind this…i would be very grateful.

From the Liberty council website:

NOTE: Filing the EEOC Complaint is required before you can file suit alleging a violation of federal law. This administrative process is the next step you should complete. The EEOC may (1) choose to attempt resolution of your Complaint with your employer, (2) file suit against your employer, or (3) issue you a “right to sue” letter that clears the way for you to file suit…..

Seems to me that going to the govt with a grievance that originated by the govt is absurd and presents a conflict of interest.

I read this to say that the EEOC has to issue a “right to sue” letter (ie permission to sue letter) before any legal proceedings can be initiated by a fired employee?

Isn’t being fired for “Covid Vaccination Mandate” a violation of constitutional rights? Why does the EEOC have to give someone permission prior to seeking redress for said violation. Seems like a process put in place to suppress legal action.

1) there is no recourse now. SCOTUS let the date of the employers mandate go by without ruling, so the mandate is now implemented, and very few companies will rescind it if SCOTUS strikes down the mandate (seems unlikely). Just as the "Biden" administration wanted.

2) There is no religious or medical exemption from masking and testing. OSHA is using its PPE precedent to require MASKS EVERYWHERE for 'unvaccinated' wage-slaves at every employer over 100 employees. and

3) There are no COVID tests available in my county. They just ran out! Amazing timing, right? Just when the SCOTUS lets the mandate go into effect!

THERE IS NO REDRESS OF GRIEVANCES from the Federal government. It is just a totalitarian tyranny now.

Hubbie filed with EEOC after mailing his whole package to Liberty Council.

Had his interview with EEOC last week. There is cause for a claim.

Waiting on next step.

Do what they say!!

Not necessarily. The Constitution only applies when there is governmental action. Even if the OSHA mandate is struck down, nothing in federal law is going to prevent people and businesses from maintaining their own private mandates (subject to law and contract). Google, Amazon and other woke companies are going to continue their own mandates. The OSHA mandate falling will prevent the government from forcing this on all businesses regardless of what they want to do but businesses can still put into place mandates subject only to federal and State law. The EEOC process is the federal guideline. States have other protections as well, but these vary widely.

Federal law does require religious accommodations and ADA accommodations. The liberty counsel website does a good job of outlining the procedures in place.

If it's the federal government doing it, then probably. If it's the business's own decision, then no. 49 out of 50 states have at-will employment, where you can be fired for any reason except protected classes like race and sex. Your best bet is to seek a religious exemption, since religion is a protected class.

If you are unable to get a religious exemption, you might want to try the control group argument. Every scientific experiment requires a control group. If you are part of that control group, then scientific protocol requires that you not be vaccinated. You're not defying the mandate; you're helping science.

A friend of mine works for a private company (I also used to work there) that has FedGov contracts. This private company is fairly conservative but the FedGov threatened to pull the contracts or at least not renew them if the private company did not have vaccine mandates and subsequently unvaccinated workers. So they capitulated and put the mandate in place and my friend staged a “sick out” and refused to return to work until the mandate was lifted or resolved in court. He is in a critical position for the company at this point so he kind of had them over a barrel so to speak. After a few weeks, the president of the company privately told him he agreed with his position and asked him personally to submit a request for a waiver. My friend said he did not religiously object but he objected on the grounds that when he served in the military he served to protect and defend the constitution of the United States, not some dictatorial regime. So, in his request for a waiver he very eloquently stated the same and his company granted the waiver.

He stood by his principles and did not lie or deceive anyone in his waiver request, but made his point very clear.

I’ve actually advised a couple of companies on how to implement exemptions. There is nothing preventing companies from creating a “check the box” exemption or from liberally granting them.

The fight happens when the company is on board with the mandate and they want to force it on their workers.

Even if there was a nationwide vaccine mandate, the companies who wanted to could help people get out of it by liberally granting exemptions. The problem is that a lot of woke companies are on board with the mandates and like the “but the government is making us” excuse as cover.

businesses from maintaining their own private mandates (subject to law and contract). >>> The only things that will stop the mandates.
1. CEO’s start dying from adverse effects of the vaccines.
2. EUA is terminated.
3. States enforce Liability for adverse reactions at both company, pharma and govt.
