what is the intent and nature of the search warrant?
does/can it specifically allow searching for messages to/from or referring to the deceased DP?
this has the external appearance of a train wreck in slow motion.
if there is nothing on the phone (eg, several grocery lists from the spouse, love letters to the spouse, photos of the spouse, etc— or even love letters to an uninvolved 3rd party), then it seems as if the advantages of turning in the phone outweigh the disadvantages in the court of public opinion (which is important if anything goes to trial).
if there is something on the phone (eg love letters to the DP, or extortion demands from the DP, etc) then dragging one’s feet might be the best option for someone in baldwin’s shoes.
