The very fact that HR-1 exists means that the Federal Government must pass a law that takes election control from the states. This means that state election control is not a Federal right granted by the Constitution and the 10th amendment clearly states that any rights not specifically granted to the Federal Government by the Constitution are states’ rights.

Therefore, by it’s very nature, HR-1 violates the 10th amendment and is unconstitutional.
