Apparently OSHA submitted a request to US Court of Appeals to please take it back, let them force the “vax”. Reportedly they were promptly told ... NO.

OSHA has now updated their web site:

On November 12, 2021, the U.S. Court of Appeals for the Fifth Circuit granted a motion to stay OSHA’s COVID-19 Vaccination and Testing Emergency Temporary Standard, published on November 5, 2021 (86 Fed. Reg. 61402) (”ETS”). The court ordered that OSHA “take no steps to implement or enforce” the ETS “until further court order.” While OSHA remains confident in its authority to protect workers in emergencies, OSHA has suspended activities related to the implementation and enforcement of the ETS pending future developments in the litigation.

This means that the 5th Circuit Court of Appeals’ stay on the mandate applies nationwide; otherwise there would be no blanket statement from OSHA.

The Centers for Medicare & Medicaid Services (CMS) and the Occupational Safety and Health Administration (OSHA) issued separate vaccine mandates for employers last week. Members should work toward CMS compliance while OSHA rule faces court challenges.

The CMS mandate requires all providers accepting Medicare or Medicaid reimbursement to develop a policy of mandatory vaccination by Dec. 5 with enforcement to begin Jan. 4, 2022. This rule remains in effect irrespective of any challenges or actions on the OSHA rule.
