I call “BS” on this one: the infrastructure bill has just been passed by the House, and it was passed by the Senate over the summer. It is now going to Biden’s desk.
If this provision were added by the House it would have to go back to the Senate unless that provision had been included in the Senate version. If that were the case, we would have heard about it long ago.
If it is in the new BBB bill, then several Democrat Senators (e.g. Testor - MT) will oppose or certainly lose their job during the next cycle. MT needs its beef industry.
Spending bills cannot originate in the U.S. Senate. It has to originate in the House and be the same bill. If what you are is the case, then it still has to go back through the Senate for final passage before it gets to the President’s desk to sign into law.
