When a defendant in a criminal case dies before judgment, the case almost always gets dismissed and I think that was what Lamberth was talking about.

as an aside, back in the day, my boss was convicted in a federal case when he was assassinated before sentencing. Near as I remember, the feds reversed his conviction because he had appealed.
