In the employers eyes, yes.
I found that out the hard way within a year of starting my first job (major defense contractor).

No, but neither do the business’s rights either. State can’t mandate to state employees. SDak is an at will state. Employees can sue and should, that’s the liberty remedy, not gov’t control.
