DC was argued to still be a war zone since there were still Confederate troops fighting, so the assassination was an act of war.

DC in 1871 became a foreign state, just like the Vatican and a part of London. Considered occupied territory after 1/14. The military is slowly and methodically plodding thru its war manual, specifically sections 11.3 and 11.4, for how to handle the occupied territory (think troops, fencing, barbed wire, blackhawk "exercises", etc) and liberate it.

As in the Civil War for Lincoln, and generals that got in the way this time around would have been served a similar fate.
