Years ago our son had a guy point a gun at his head and fire three times. It jammed each time. They charged the perp with assault with a deadly weapon. I asked the DA why not attempted murder. He said that its the same penalty and that the assault is easier to prove.
That’s a good explanation. I HOPE that’s the reasoning in this instance.
