I understood him to mean that the Senate voted, via a simple majority, the impeachment trial to be constitutional - where the constitution is clear about who gets impeached\tried.
(Even the CJ declined to preside over that trial.)
At that point, it should have been a matter for the courts\SCOTUS to decide.
