My first thought was “Spot on!” But after a little thought, it occurs to me that Congress is political: It doesn’t do what its members think in terms of legality; it does what it thinks the members’ constituents want/demand. At least, that is a primary consideration.

Whether Congressional action is Constitutional or not is a call for the Court.

Problem goes back decades when Congress made themselves paid referral employees. Prior to that they were paid by and directed by each state. The legislators had the ability to fire anyone that violated their states directives.
