True. But technically, the code transfers, etc. shouldn't occur before inauguration. It's conceivable that they could wait until inauguration, and once the oath is given, arrest Biden on the spot. That would be the true deadline. Waiting beyond that wouldn't make sense because they'd be fighting from a position of weakness.
