He couldn’t because the National Archives did not send over - last night they said they only sent electors signed by state govs
The law provides that a copy is sent to the Archives and to the President of the Senate, as I recall. A copy of the alternate electors should have been sent certified mail to Pence, with copy to Trump. I find it hard to believe they didn’t get a copy to Pence.
As Churchill said to Chamberlain: Mr. Pence—“you had a choice of dishonor or war. You chose dishonor, You will have war.”
The other thing archives said was that they did receive the other electors but were thus only private communications and only revealed through FOIA
Just dang...I always wondered how the “non-certified” list of electors was going to get to the VP.
The 12th doesn’t mention “non-certified” but they are mentioned in the Electoral Count Act.
we don’t seem to cover all the bases...who were the “tellers”?...seems it should have been their job.
“...Two tellers shall be previously appointed on the part of the Senate and two on the part of the House of Representatives, to whom shall be handed, as they are opened by the President of the Senate, all the certificates and papers purporting to be certificates of the electoral votes, which certificates and papers shall be opened, presented, and acted upon”
