As Trump is speaking, Pence releases statement saying he won’t attempt to throw out election results: “my oath to support and defend the Constitution constrains me from claiming unilateral authority to determine which electoral votes should be counted and which should not.”

If Pence kicks it back to the state legislatures, then he won’t be doing that. State legislatures will be responsible for appointing their own electors, which is what the Constitution says.
