Not sure this is correct. The rules are codified in Title 3, Chapter 1. Pence has to open all presented slates - certified and not certified.
15) Remember, we very well may NOT have the to GA seats filled, so the final numbers might be 49 Ds (Kelly seated now, Hickenlooper on Jan. 3 ) & only 49 Rs with recounts holding up the 2 GA seats.
If a count or recount doesn't call a winner in GA before 01/06/2021, Loeffler is still the Senator and should be at that vote. She was appointed to a seat that doesn't expire until 2022

not 270 - constitution says a majority of the whole number of Electors appointed. It gets dicey when a slate gets rejected. Is it still a majority of 570 or a majority of 570 minus the rejected slate?
