A) Trump: I will sign the Omnibus and Covid package with a strong message that makes clear to Congress that wasteful items need to be removed.

B) Trump: I will send back to Congress a redlined version, item by item, accompanied by the formal rescission request to Congress insisting that those funds be removed from the bill.

I'm not a lawyer but it looks like The Impound Control Act only allows the President to withhold certain funding for 45 days and then after that if Congress doesn't approve of it the funds must be made available.

So if I'm reading this right, it just means that the funds will be held up for 45 days and then released, because there's no way that Congress is going to override their own pork filled bill they passed a week ago.

Yes, but now it will be congress holding it up, not Trump. Not sure the American people will see it that way though. Especially if their relief is held up another 45 days and unemployment as well.

It was a complete cave. Trump signed the Bill (everything that was in in), but his people are saying he can withhold some funds.

Yes, a vetoed bill can be overrided normally. But Not here if he doesn’t veto it.

In this case he could have sat on the bill and did nothing. (pocket vetoed), let the government shut down and the next Congress in a few weeks would have to pass a new bill.

This congress ends before the 10 days is up . Because the next congress is less than 10 days away he doesn’t have to veto, it will die in its own.

If congress would be in session for more than 10 days, if he didn’t veto it becomes law.

I'm trying to skim through the act looking for something about Congress' procedure following Trump's invocation of the act. Could it be that We the People get the stimulus money, but Congress has to do something to double down on the pork, exposing themselves further?

Per the Senate legislative day - A "day" that starts when the Senate meets after an adjournment and ends when the Senate next adjourns. Hence, a legislative day may extend over several calendar days or even weeks and months.

Just saying, if they refuse it will be in the face of every single American watching at this moment... and we are all more invested in what’s happening in dc now more than ever soo they should tread lightly

But because Congress adjourns on the 3rd, inside the 45 day window, I think the bill would be pocket vetoed if Congress doesn't approve.

A lot can change in 45 days.

So basically funding that is on item vetos can be withheld but the direct checks and unemployment can be finalized quickly while waiting on line item vetos?

As far as I can tell the direct checks and unemployment and stuff he approved, the things he didn't approve of will just be delayed by 45 days and then funded anyways

The next congress is what matters Trump got his hamburder and doesn't pay till Tuesday. 5D

Me too. But someone mentioned the continuous 45 days in session clause. This congress ends jan 3. And all old business has to be resubmitted.

The original voting margin in both houses was a veto proof majority, so if he had vetoed they could have overridden. At least this stops the clock.

There was some wording about the 45 days not having to be contiguous, but my eyes glazed over during that point TBH.

Don't we have a new Congress in less than 2 weeks? Would they have to start over with their Pork?
