We’re you on line the day I gave the tic tac toe explanation. Cases headed toward the Supreme Court must follow a certain order. Think X & O. There cannot be two X together or Two Os. So sometimes a judge rules with an O just to advance the case one step up the ladder to the court. He must rule so the case can be appealed. Other wise there are two X in a row and no case at a lighter level. Am more concerned when judges don’t decide in this orderly fashion. To the lay person who doesn’t understand this it may appear that the nudge made a bad (corrupt in your book) decision. Quite the opposite., He understands the system and is doing his part.

Tonight the Senate confirmed Thomas Kirsch to replace Justice Amy Coney Barrett on the 7th Circuit Court of Appeals, adding to a long list of Conservative judges confirmed under President @realDonaldTrump! Congratulations to this Great Hoosier, Judge Thomas Kirsch! pic.twitter.com/qomsrvXBCL— Mike Pence (@Mike_Pence) December 15, 2020
