You conveniently left out the Insurrection Act. It is not an EO. He could invoke that, as well. It is a LAW and has been around since the late 1700s. It was rewritten and split into four piece for use at the beginning of this century. And it is constitutional.

So what is your beef now about using legal presidential power given to the president by the Congress? The Supreme Court has no say in it unless somebody challenges his use of the law.
