Yes. Moving on up with the help of the Obama appointed judge. He did not delay his decision or require them to present any evidence. IOW he did his job. This is how the judicial system is suppose to work. IIRC third court of appeals send it up to Alito. Hopefully they will be as quick. Any evidence that is not allowed must be allowed at the next level.
