Because it is a political slogan, not a statement.

And promoting that political slogan is against the law for the School District, though no one will actually be charged.

Technically, it should. When used to describe race, Black becomes a proper noun just like Latino or Asian, and unlike "black" the color of a crayon.

Problem is though, is the refusal to capitalize "White" for the same reason because, I dunno, White Supremacy or something...
