Now what does it mean to petition the Supreme Court? I had thought he needed to go through state courts and get a negative opinion before getting to go to The Supremes?
The goal is to get to the SCOTUS because their ruling would be applicable to all states D & R. But you must have a lower decision that does not go your way in the Court of Appeals in order to ask the SCOTUS to take their case.
Depending on type of case if can be done either way. Better chance of building a case if it heard in lower court. If a case like it has never been heard in the courts system, there are no case history to build a case on. It’s original ??????? A legal term meaning its decision will be the first of its kind on the subject. The. It’s a waste of time to weave through lower courts.
