I think the result in this case has more to do with the government’s desire to keep Subway’s taxes high than it has to do with Subway’s bread.

The basic purpose of government, whether here or there, is the extraction of money to pay for more government.
The Subway owner is trying to lower the price of his product to the public. He won’t make any more money by winning the lawsuit. He might, however, sell more product as it will look more attractive when compared with the competition. Or, perhaps burgers and other alternatives are not taxed because they are staple foods?
