The key there is that when Sullivan intervened by filing a motion to the Court of Appeals, he became a party to the case. By law a judge cannot hear a case to which he is (became) a party. At that point, after the appeal (NOW) is when such a motion to recuse became ripe. Sullivan knows he is outside the law and is shoving to the side.
