I did read the complaint, I did not see any mention of a 14 amendment violation.
Gorsuch makes a 14th amendment argument to use as the basis of a 1st amendment dissent.
This is not just a 1st amendment case.
It is as a much a 14th amendment Sec. 1 issue...
"No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States;
nor shall any state deprive any person of life, liberty, or property, without due process of law;
nor deny to any person within its jurisdiction the equal protection of the laws."
If it's not mentioned in the complaint can SCOTUS stilll refer to it as a reason for\against ?

My 2 pennies worth...Gorsuch wrote a dissenting opinion to a Judgement by the court. I believe that he can refer to anything he wants. “My daddy done tole me to go to Church” so I decided that Churches are better than Casinos. (or Whatever)
