Trademark is associated with USE of the mark or word. Whatever this guy thinks he has, I think he doesnt. It's not just a trademark. For that he can sell one bumper sticker a year to his brother-in-law and it's a legitimate trademark. What's likely at issue is copyright and for that he only needs to publish it once.

My thought as well. If he applied for the trademark without intent to "use" it, I believe they consider it a "bad faith" application and will ultimately reject it.
