From what I read, if Sullivan does nothing and the time is up, it’s all over. He has to requesnt the en banc hear the case before time’s up. And even then I don’t know the details.

Guarantee you they'll wait until the last day and then make the request for November. At the least, they figure they can throw something out there that will take several weeks to resolve.

One of the tricks Hillary did during the Whitewater investigation, during discovery, they turned the files over at the end of the business day deadline, but didn't include some of the documents, added thousands of pages of unrelated documents, pulled all the staples out, and shuffled all of the pages together so pages of one document would be spread out throughout the entire document stack.
