The Posse Comitatus Act and Related Matters: The Use of the Military to Execute Civilian Law
The Posse Comitatus Act outlaws the willful use of any part of the Army or Air Force to execute the law unless expressly authorized by the Constitution or an act of Congress. The
penalty for that crime,
the misuse, is in Title 18.
Title 10 is ARMED FORCES
Does any body understand this?
There are two important Chapters to understand what is going on here. These Chapters are both contained in 10 USC Subtitle A, PART I: ORGANIZATION AND GENERAL MILITARY POWERS
Chapter 13 is part OF Title 10. (Insurrection Act)
Chapter 15 is part OF Title 10 as well. (Posse Comitatus Act)
H.R.7297
To amend title 18, United States Code, to prohibit the use of an Armed Force under the jurisdiction of the Secretary of a military department as a posse comitatus or otherwise to execute the laws, and for other purposes. There is no penalty there for misuse, it's to prohibit
the use.
I can't be the
only one who sees that H.R.7297 does
not belong in Title 18 and should be to amend Title 10. There is no
penalty for doing so in the proposed bill. There is only a declaration.
It's legal mumbo jumbo! He's trying to pass a law and place it where it shouldn't go.
