So my understanding is this: BO did this by EO and it isn't legal from the statement of today...Our President sent the DACA in like BO did and the Court said it was done wrong...so BO was wrong and so is Our President...it has to go through legislation voted on and then passed on to the Supreme Court???

I think, based upon Kavanaugh's Comments in Dissent, that if Trump is reelected the DHS will be able to "Dot the i's and cross the t's" to get this done.

SCOTUS did not rule on the legality of DACA this time around, just the procedural issues.

In 2016 the SCOTUS split 4-4 on the constitutionality of DACA, due to 187 of Justice Scalia.
